Terms of Service

Please read the following Terms of Service before using the website or services offered by Electricity Maps ApS (CVR-no. 39101211).

1. Introduction

These terms of service ("Terms") govern your access to, and use of the Services and Data provided by Electricity Maps, including but not limited to the website, API, Data (API Data, CSV Data), documentation, and any related products or services (collectively, the "Services"). By using the Services, you (the "Client") agree to be bound by these Terms. If you have entered into a separate written contract with Electricity Maps, that contract and these Terms shall be read together (collectively, the "Agreement"). In the event of any conflict, the specific provisions of the separate contract shall prevail.


2. Definitions

  • Agreement: Collectively, these Terms together with any applicable Subscription, Order Form, or other commercial contract between the Client and Electricity Maps, which together govern the Client's access to and use of the Services and Data.

  • API: The application programming interface, including API tokens and documentation.

  • API Data: Data provided via the API.

  • Client: The individual or entity using the Services, whether free or paid, including those who have entered into a Subscription with Electricity Maps.

  • CSV Carbon Accounting Use: Use of CSV Data solely for the purpose of internal scope 2 carbon accounting and emissions reporting.

  • CSV Data: Data provided through downloadable CSV files.

  • Commercial Use means any Internal Commercial Use or External Commercial Use as described in section 4 (License Grant and Restrictions) that provides business value to a commercial entity.

  • Data: API Data and CSV Data, collectively.

  • Derived Data: Data that has been substantially transformed through analysis, aggregation, modeling, or other processing such that the original Data cannot be reverse-engineered or extracted, and the output represents new insights, calculations, or conclusions rather than a reformatted presentation of the original Data.

  • Electricity Maps Marks: Electricity Maps' name, logo, and other branding.

  • Entry Data: Raw data from public or third-party sources used to generate the Services.

  • Evaluation Use: Limited use of the Services or Data for internal testing, experimentation, evaluation or proof-of-concept purposes within your organization. Evaluation Use must remain non-commercial, non-production, and may not be relied upon for business operations, compliance, or used in any externally available or revenue-generating product, service, or demonstration, including minimum-viable-products or pilots made available to customers or the public.

  • Force Majeure: Any event or circumstance beyond reasonable control that directly or indirectly prevents or delays the performance of Electricity Maps' obligations under these Terms, including natural disasters, war, terrorism, labor disputes, cyberattacks, failure of suppliers or utilities, or government actions.

  • Free Use: Means the use described in section 4 (License Grant and Restrictions).

  • License Fee: The recurring or one-time fee payable by the Client to Electricity Maps in exchange for paid access to the Services under an Agreement. Unless otherwise specified, any License Fee is non-refundable and exclusive of applicable taxes.

  • Material Change: A change that materially reduces or increases the Client's rights or obligations under these Terms as described in section 17 (Updates to these Terms).

  • Order Form: A separate written or electronic commercial contract between the Client and Electricity Maps that in addition to these Terms further specifies commercial terms such as pricing, duration, and scope of the Services and Data.

  • Services: Any Electricity Maps websites, apps, APIs, Data (including API Data and CSV Data), software, documentation, dashboards, Technology or other related products and services made available by Electricity Maps, whether free or paid, under an Agreement.

  • Subscription: A paid plan purchased through the Electricity Maps website, Order Form, or other commercial agreement that grants time-limited access to specified Services and Data, subject to these Terms.

  • Third-Party Licensed Data: Means data that is licensed from third-party providers which requires a separate redistribution license as described in section 4 (License Grant and Restrictions).

  • Technology: The underlying software, systems, algorithms, and other technical components used by Electricity Maps to provide the Services.

  • Term: The period during which the Client is authorized to access the Services and Data under these Terms or any applicable Subscription.

  • Unmodified Data: Data presented in its original form or with only superficial modifications (such as unit conversions or visual reformatting) where the underlying values remain substantially unchanged.

3. License Grant and Restrictions

License

For the duration of the Term, the Client is granted a non-exclusive, non-transferable, revocable, worldwide license to use the Services and Data for one or more of the following use types, subject to its Subscription:

  • Free Use. Without a paid Subscription, the Client may use the Services and Data for:

    • Evaluation Use: Testing, experimentation, or proof-of-concept internally in your organization. Evaluation Use must remain non-production and may not be relied upon for business operations, compliance, or used in any externally available or revenue-generating products or activities.

    • Personal and Academic Use: Personal or academic projects, even if deployed live on a small scale (e.g., hobbyist websites or home assistant integrations), provided they are non-commercial and not relied upon by a business or other organization.

    • CSV Carbon Accounting Use: CSV Data is made freely available solely for your organization’s own internal scope 2 carbon accounting and emissions reporting. You may not use the Data to perform carbon accounting, analysis, or emissions reporting for any third parties or customers. Any such use constitutes Commercial Use and requires a paid Subscription.

  • Commercial Use. Any Commercial Use of the Services or Data requires a paid Subscription. Depending on the type of Subscription the Client has, the Client may use the Services and Data for either:

    • Internal Commercial Use: Use of the Services and Data by the Client's employees or contractors solely for internal business purposes, such as dashboards, analyses, modeling, or internal reports. It excludes any external publication or distribution of the Data or Derived Data. Contractors may use the Data only on the Client's behalf and must not use, retain, or repurpose it for other customers or projects.

    • External Commercial Use: Use of the Services or Data, whether modified or unmodified, outside the Client's organization in any commercial product, service, solution, advisory project, or other external-facing context. This includes use in reports, publications, or communications issued by or for a commercial entity, even if provided free of charge. For clarity, this does not include emissions reporting for internal scope 2 carbon accounting as permitted under CSV Carbon Accounting Use.

Transitioning Between Use Types

It is the Client's responsibility to ensure that its usage complies with the scope, purpose, and limitations defined in the Agreement. If the Client's use of the Services or Data changes in a way that require a different license (for example, from Internal to External Commercial Use or from Evaluation Use to Commercial Use), the Client must obtain the appropriate licensing before commencing such use.

Failure to secure the correct license or any misuse may result in retrospective invoicing in accordance with section 13 (Consequences of Misuse and Incorrect Licensing).

Prohibitions

You are not allowed to do any of the following without Electricity Maps’ prior written consent.

  • Reproduce, publish, or resell Unmodified Data,

  • Reverse engineer our Technology,

  • Scrape or otherwise through automated means extract from our websites or Data,

  • Use our Data or confidential information to create competing services, or

  • Use the Data to train, fine-tune, or validate any machine learning model, algorithm, or artificial intelligence system for any purpose, including internal use.

Third-Party Licensed Data

Certain Data provided through the Services is sourced under license agreements with third-party providers and is subject to redistribution restrictions ("Third-Party Licensed Data"). This includes but is not limited to measured day-ahead electricity prices from Nord Pool and/or EPEX. You can identify whether a datapoint constitutes Third-Party Licensed Data by checking its source field in the API response. Any datapoint whose source reflects a third-party provider (such as Nord Pool or EPEX) is subject to these redistribution restrictions.

Electricity Maps is not entitled to sub-license Third-Party Licensed Data, and therefore the Client may not disclose, display, redistribute, or otherwise make Third-Party Licensed Data available externally (including through graphs, dashboards, or reports) without first obtaining a redistribution license directly from the relevant third-party provider (e.g., Nord Pool or EPEX). Electricity Maps makes no warranties with respect to Third-Party Licensed Data and disclaims all liability arising from the Client's use or redistribution of it. For clarity, forecasted day-ahead prices and other Derived Data produced by Electricity Maps are not considered Third-Party Licensed Data and are licensed under these Terms without the above restriction.

Attribution and modifications

If your Subscription allows you to make Data available externally, you must include a clear attribution, such as "Source: ElectricityMaps.com" or our logo. If you modify our Data, you must clearly disclose the modification and not imply endorsement by Electricity Maps.

4. Evaluation and Trial Access

Evaluation Use and trial access is provided solely for the purposes defined under Evaluation Use in section 3 (Definitions) and are limited to non-production testing and assessment of the Services and Data.

  • Trial Access. Electricity Maps may, at its discretion, grant temporary access to expanded features or data for evaluation purposes. Trials are time-limited and subject to any conditions communicated when access is granted.

  • Restrictions. During Evaluation Use or trial access, the Client may not use the Services or Data to generate revenue, deliver customer-facing features, or operate any production system. Any such use constitutes Commercial Use and requires a separate paid Subscription.

  • Expiry and Data Deletion. When the Client's Evaluation Use or trial access period ends, its right to use the Services and Data automatically terminates. The Client must delete any Data obtained during that period unless and until it enters into a separate Subscription that expressly permits continued use.

5. Accounts and API Tokens

Parts of the Services or Data may require creation of an account or use of an API token.

Unless otherwise permitted under the Client’s Subscription, accounts and API tokens are strictly personal and confidential. They may not be shared or used by any individual or legal entity other than the Client, including group companies. Any form of account or API token sharing or redistribution arrangement is strictly prohibited.

The Client is responsible for safeguarding its credentials and shall be solely liable for any and all activities conducted under its accounts and API tokens. The Client must promptly notify Electricity Maps of any unauthorized access, suspected compromise, or misuse of an account or API token.


6. License Fees and Payment

All prices are quoted in Euros (EUR) and are exclusive of VAT and any other applicable taxes.

Invoices are payable by the payment method specified therein within 30 days from the invoice date. Interest will accrue at 8% p.a. on any overdue amount from the due date until the date of full payment.

If any payments are overdue by more than 5 days, Electricity Maps reserves the right to suspend or withhold delivery of the Services or Data until the balance is settled in full.

Unless otherwise required by applicable law, any prepaid License Fee is non-refundable and will be forfeited in the event of early termination of the Agreement.


7. Intellectual Property Rights

All Technology, rights, titles, and interest in and to the Services and Data, including all associated intellectual property rights, remain the sole property of Electricity Maps and our licensors. Except as expressly agreed in writing, no Technology, rights, title, or interest are sold, assigned, or otherwise transferred to the Client under this Agreement.

The Client retains all intellectual property rights to any content it develops independently by use of the Services or Data. However, the Client hereby grants Electricity Maps a non-exclusive, royalty-free, perpetual, worldwide, transferable, and sub-licensable license to use, reproduce, modify, distribute, publish, and process any such non-personal content or feedback submitted in the Services, for the purpose of improving the Services, without requiring further consent, notice, or compensation.

The rights granted to Electricity Maps under this clause are irrevocable and shall survive the expiration or termination of this Agreement for any reason.


8. Commercial Reference

Electricity Maps is granted the right to display the Client's company by name and logo as a user of the Services on our website, social media, and other marketing channels. This may include the use of the Client's logo and public-facing brand name, derived from the account registration (e.g. email domain or company profile).

The Client can opt out of this use at any time by contacting Electricity Maps at the details outlined in section 19 (Contact Information).


9. Confidentiality

Confidential information may only be used for the performance of the Agreement. Neither party may disclose the other party's confidential information without their consent and must protect it with at least the same degree of care as the party uses to protect its own confidential information, but in no event less than reasonable care. Confidential information does not include information that is or becomes public, is independently developed, or is lawfully received from a third party without restriction.

The confidentiality obligations shall persist for 5 years after termination for any reason.


10. Data Protection

Both you and Electricity Maps must comply with all applicable data-protection laws, including the EU General Data Protection Regulation (GDPR).

For free, evaluation, or trial use, Electricity Maps acts as an independent controller for any personal data it collects, as described in the Privacy Policy. For paid customers, Electricity Maps acts as a data processor for any personal data processed on the customer’s behalf while providing the Services.

The following data-processing terms apply only if you have entered into a paid Subscription, Order Form, or other Agreement with Electricity Maps. When acting as a processor, Electricity Maps will:

  • Process Personal Data only for the purpose of providing the Services and in accordance with your instructions. If Electricity Maps considers that an instruction constitutes a violation of the applicable regulations, it shall immediately inform you.

  • To the extent possible, assist you in fulfilling obligations to respond to requests to exercise the rights of data subjects.

  • Notify you within 48 hours of any Personal Data breach within the meaning of the Personal Data Protection Legislation. Such notification shall be accompanied by any relevant documentation to enable you, if necessary, to notify the breach to the competent supervisory authority.

  • Take all necessary precautions to preserve the confidentiality and security of the Data processed and, in particular, prevent it from being distorted, damaged or communicated to unauthorized third parties, and more generally, implement appropriate technical and organisational measures.

  • Ensure that persons authorised to process personal data under this agreement (i) undertake to respect confidentiality or are subject to an appropriate legal obligation of confidentiality (ii) receive the necessary training in the protection of Personal Data.

  • Assist you in carrying out impact assessments and consultations, questions, requests or due diligence by the competent supervisory authority, including providing you with the necessary documentation to demonstrate compliance.

  • Delete or return all personal data at the end of the Services unless legally required to retain it.

  • Inform you if Electricity Maps is required by a public authority to disclose personal data, unless prohibited by law for reasons of public interest.

These clauses constitute the written data-processing agreement required by Article 28 of the GDPR for commercial customers.


11. Term and Termination

Term

These Terms apply from the moment the Client first accesses or uses the Services or Data and remains in effect until terminated by either party as set out below. For Clients with a Subscription, these Terms remain in effect for the duration of the Subscription, including any renewals or extensions agreed in writing.

Renewal

Unless otherwise specified, all Subscriptions will automatically renew for successive terms of equal duration to the initial term, unless either party provides written notice of non-renewal in accordance with the notice period specified in the Subscription.

Your Termination Rights

If you use the Services on a Free Use basis, you may stop using them and delete your account at any time, which will automatically terminate your license under these Terms.

If you use the Services for Commercial Use, you may terminate your Subscription by providing written notice in accordance with the termination notice set forth in that Subscription. Ceasing use of the Services or deleting your account alone does not terminate your contractual obligations under the Agreement.

Our Termination Rights

Unless a longer notice period is specified for your Subscription, we may terminate your account and access to the Services with 30 days' written notice. Furthermore, we reserve the right to discontinue the Services in general at any time. In such cases, we will provide reasonable prior notice and issue a prorated refund for any prepaid License Fee.

Suspension by Electricity Maps

We reserve the right to suspend your account and access to the Services immediately if you breach these Terms or fail to pay any applicable License Fee. Such suspension shall not limit our right to pursue any other remedies available under applicable law, including but not limited to seeking damages or injunctive relief. We shall not be liable for any losses or damages incurred by the Client as a result of such suspension.

Termination for Cause

Either party to the Agreement may terminate it for material breach by the other party, provided that written notice of such breach has been given and a minimum 30-day cure period has expired without remedy.

Effects of Termination

Upon termination, all licenses and access rights end immediately, and you must cease all use of the Services and Data. However:

  • You remain obligated to pay any outstanding amounts to Electricity Maps.

  • You may retain previously received Data solely for internal, non-commercial archival purposes, provided it is not used in any active or future product, service, or commercial process.

  • You must stop using Electricity Maps Marks.

  • You must delete our confidential information or return it at our request.

Termination does not affect any rights or obligations accrued up to the termination date. Any provisions of the Agreement that, by their nature, are intended to survive termination or expiration, including but not limited to confidentiality, intellectual property rights, limitations of liability, indemnification, and dispute resolution, shall remain in effect to the extent necessary to fulfill their intended purpose.


12. Audit and reporting

The following audit and reporting provisions only apply if you have entered into a Subscription with Electricity Maps.

Audit Rights

Electricity Maps reserves the right, at its sole discretion, to audit the Client's use of the Services and Data to verify compliance with the Agreement, particularly regarding:

  • the volume of API requests,

  • the purpose and scope of use of Electricity Maps Data,

  • where relevant, the number and type of external end-users, resellers, or white-labelled deployments and the Data they access, and

  • the accuracy of information provided for pricing or discount eligibility, including company size, number of employees, revenue, or other criteria used to determine applicable pricing tiers (such as startup or small enterprise rates).

Electricity Maps will provide at least 15 days’ prior written notice before conducting any audit. The Client agrees to cooperate by providing Electricity Maps, or an independent auditor appointed by Electricity Maps, with reasonable access to relevant documentation (including usage logs, reporting tables, or business records) necessary to perform the audit.

Audits will be conducted during normal business hours and in a manner that minimizes disruption to the Client. Any information shared or accessed during such audits will be treated as confidential information.

Reporting Obligations (if applicable)

If the Client's Subscription and use of the Services involves providing a version of the Client's solution to external end-users or reselling access to Electricity Maps Data, you agree to provide, upon request and on a reasonable basis, a quarterly report specifying for each month of the preceding quarter:

  • the number of external end-users,

  • the list of end-users (including company names, if applicable), and

  • the Data accessed by those end-users.

The report shall be provided within 30 days after receiving a request from Electricity Maps.

13. Consequences of Misuse and Incorrect Licensing

If Electricity Maps becomes aware of misuse, incorrect licensing, or other non-compliance with the Agreement, for example through an audit or report, Electricity Maps reserves the right to issue an invoice to the Client for any underpaid License Fees. Such fees will be calculated based on the actual scope, level, and duration of the unauthorized use or non-compliance.

This remedy is without prejudice to any other rights or remedies available to Electricity Maps under applicable law, including but not limited to the right to seek injunctive relief, damages, or termination of the Agreement.

14. Warranty Disclaimer

The Services and Data are provided by Electricity Maps on an "as is" and "as available" basis, without any guarantees regarding uptime, response time, or the completeness of the data. Electricity Maps will make commercially reasonable efforts to ensure the availability, functionality, and accuracy of the Services and Data throughout the Term.

The Services and Data are intended solely for informational purposes and do not constitute, nor should they be interpreted as, any express or implied representation, warranty, or advice concerning specific real-world outcomes. The Client acknowledges that certain Entry Data, such as electricity, greenhouse gas, and weather information is provided by third parties and is inherently uncertain and subject to changes and errors.

Accordingly, Electricity Maps expressly disclaims all warranties, whether express or implied, including but not limited to warranties of accuracy, completeness, timeliness, merchantability, or fitness for a particular purpose with respect to the Services or Data.


15. Limitation of Liability

The Client acknowledges that any use of the Services and Data is at their own risk. To the fullest extent permitted by applicable law, Electricity Maps shall not be liable to the Client or any third party for any damages, whether direct, indirect, incidental, consequential, or punitive, arising out of or in connection with the Agreement, including from inaccuracy, incompleteness, delay, or obsolescence in the Services or Data, or the Client’s use of the Services or Data in general. Such damages may include, without limitation, loss of profits, loss of data, loss of goodwill, and damages resulting from Force Majeure events.

Except in case of Electricity Maps’ gross negligence or willful misconduct, the total cumulative liability of Electricity Maps for claims arising out of the Agreement shall in no event exceed an amount equal to the total License Fees paid by the Client to Electricity Maps during the 6 months preceding the event giving rise to the claims.


16. Indemnification

The Client agrees to fully indemnify Electricity Maps against any financial consequences, losses, liabilities, damages or costs incurred by Electricity Maps because of any claim, demand or legal action against Electricity Maps, brought by a third party, to the extent such claim arises out of or relates to the Client’s use of the Services or Data in breach of the Agreement.

17. Updates to these Terms

Electricity Maps may update these Terms from time to time to reflect changes in our Services, operations, costs, or legal requirements. When we make changes, we will post the revised version online and update the “Last Updated” section at the top of this page.

For Clients using the Services on a Free Use basis, use of the Services and Data after the effective date of a change constitutes acceptance of the updated Terms. Alternatively, you may cease use of the Services and terminate the Agreement in accordance with section 11 (Term and Termination).

For Clients accessing the Services on a Commercial Use basis, subject to a Subscription or other commercial contract with Electricity Maps, if any update materially reduces your rights or increases your obligations under these Terms (a "Material Change"), we will provide at least 30 days’ prior notice by email or through the Services before the change takes effect.

Material Changes include updates to:

  • License Fee or billing terms,

  • Service availability or uptime commitments,

  • Liability or indemnification provisions, or

  • Data protection commitments.

By continuing to use the Services after the effective date of an update, you accept the updated Terms. If you do not agree to a Material Change, you may terminate the Agreement by giving written notice before the change takes effect.


18. Miscellaneous

  • Anti-corruption. Both parties agree to comply with all applicable anti-corruption Assignment. Electricity Maps may assign the Agreement and any rights under the Agreement without the Client's prior consent. The Client may not assign the Agreement or sub-license any rights without our prior consent.

  • Subcontracting. Electricity Maps is entitled to use subcontractors to fulfill the Agreement but shall remain responsible for their performance as if it was our own.

  • Entire Agreement. These Terms, together with any applicable Subscription, Order Form, or other commercial contract, and all documents expressly incorporated by reference, constitute the full and final Agreement between the Client and Electricity Maps regarding the Services. The Agreement supersedes all prior negotiations, understandings, communications, and representations, whether oral or written.

  • Force Majeure. Electricity Maps shall not be liable for failure or delay in performance caused by a Force Majeure event. The Client may terminate the Agreement if the Force Majeure event persists uninterrupted for more than 30 days.

  • No Waiver. Failure or delay to exercise any right or remedy under the Agreement shall not constitute a waiver of that right or remedy. All waivers must be in writing and signed by the party granting the waiver.

  • Severability. If any provision is found invalid or similar, the rest of the Terms shall remain in effect. We shall in good faith negotiate a valid and enforceable provision that most closely reflects the original intent of the invalid provision.

  • Governing Law and Jurisdiction. Any disputes arising out of the Agreement shall be exclusively governed by the laws of Denmark, excluding choice of law rules. Subject to arbitration, the courts of Denmark shall have sole and exclusive jurisdiction.

  • Dispute Resolution. Disputes will be resolved by simplified arbitration in English through the Danish Institute of Arbitration in Copenhagen.
