Terms of Service

These Terms of Service govern your use of the Electricity Maps services & products.

Introduction

These Terms of Service ("Terms") govern your use of the Electricity Maps services, which include the API, data downloads (API Data, CSV Data), documentation, and related technology (collectively, the "Services"). By using the Services, you agree to these Terms. If you have a separate written agreement with Electricity Maps ApS ("Electricity Maps"), that agreement and these Terms will be read together, with the written agreement taking precedence.


Supplemental Website Terms

Your general use of our website and app is also subject to our Terms of Use. If there is any conflict between the two, these Terms will control your use of the Services.


Definitions

  • Addendum: A separate written agreement that supplements these Terms, outlining pricing, scope, or other commitments.

  • API: The application programming interface, including tokens and documentation.

  • API Data: Data provided via the API.

  • CSV Carbon Accounting Use: Use of CSV Data solely for the purpose of internal scope 2 carbon accounting and emissions reporting.

  • CSV Data: Data provided through downloadable CSV files.

  • Commercial Use means any Internal Commercial Use or External Commercial Use that provides business value to a commercial entity. This includes:

    • Internal Commercial Use means use of the Services or Data by your organization’s employees or contractors solely for your internal business purposes, such as dashboards, analyses, modeling, or internal reports. It excludes any external publication or distribution of the Data or Derived Data. Contractors may use the Data only on your behalf and must not use, retain, or repurpose it for other clients or projects.

    • External Commercial Use means making the Services or Data, whether modified or unmodified, available outside your organization in any commercial product, service, solution, advisory project, or other external-facing context. This includes use in reports, publications, or communications issued by or for a commercial entity, even if provided free of charge. For clarity, this does not include emissions reporting from internal scope 2 carbon accounting as permitted under CSV Carbon Accounting Use.

  • Data: API Data and CSV Data, collectively.

  • Derived Data: Data that has been substantially transformed through analysis, aggregation, modeling, or other processing such that the original Data cannot be reverse-engineered or extracted, and the output represents new insights, calculations, or conclusions rather than a reformatted presentation of the original Data.

  • Electricity Maps Marks: Electricity Maps' name, logo, and other branding.

  • Entry Data: Raw data from public or third-party sources used to generate the Services.

  • Evaluation Use: Limited use of the Services or Data for internal testing, experimentation, or proof-of-concept purposes within your organization. Evaluation Use must remain non-commercial, non-production, and may not be used in any externally available or revenue-generating product, service, or demonstration, including MVPs or pilots made available to customers or the public.

  • Force Majeure: Any event or circumstance beyond reasonable control that prevents or delays the performance of Electricity Maps' obligations under these Terms, including natural disasters, war, terrorism, labor disputes, cyberattacks, failure of suppliers or utilities, or government actions.

  • Subscription: A paid plan purchased through the Electricity Maps website or order form that grants time-limited access to specified Services and Data under these Terms.

  • Trial: Temporary, discretionary access to expanded features, data, or usage granted by Electricity Maps for evaluation purposes.

  • Unmodified Data: Data presented in its original form or with only superficial modifications (such as unit conversions or visual reformatting) where the underlying values remain substantially unchanged.

  • User: Any individual or entity using the Services, whether free or paid.

License Grant and Restrictions

You are granted a non-exclusive, non-transferable, revocable, worldwide license to use the Services subject to these Terms.

  • Free Use. By default, you may use the Services and Data for:

    • Evaluation Use: For testing, experimentation, or proof-of-concept within your organization. Evaluation Use must remain non-production and may not be relied upon for business operations, compliance, or customer-facing applications.

    • Personal and Academic Projects: For personal or academic projects, even if deployed live (e.g., hobbyist websites or Home Assistant integrations), provided they are non-commercial and not relied upon by a business or other organization.

    • CSV Carbon Accounting Use: CSV Data is made freely available solely for your organization’s own internal scope 2 carbon accounting and emissions reporting. You may not use the Data to perform carbon accounting, analysis, or emissions reporting for any third parties, clients, or customers. Any such use constitutes Commercial Use.

  • Commercial Use. Any Commercial Use of the Services or Data, whether an Internal or External Commercial Use, requires a paid Subscription or a separate signed Addendum. You must ensure your use complies with the scope, purpose, and limitations defined in your active Subscription or Addendum. Any use of the Services or Data outside that defined scope or use case requires Electricity Maps’ prior written consent. All Commercial Use remains subject to these Terms.

  • Transitioning Between Use Types. If your use of the Services or Data changes in a way that would require a different license (for example, from internal to external use, or from evaluation to commercial use), you must obtain appropriate licensing before continuing such use.

  • Attribution and modifications. If you make Data available externally (where permitted), you must include clear attribution, such as "Source: ElectricityMaps.com" or our logo. If you modify our Data, you must clearly disclose the modification and not imply endorsement by Electricity Maps.

  • Prohibitions. You must not resell unmodified Data, reverse engineer our technology, scrape our Data, or use our confidential information to create competing services. You may not use the Data to train, fine-tune, or validate any machine learning model, algorithm, or artificial intelligence system for any purpose, including internal use, without Electricity Maps’ prior written consent.

  • Third-Party Licensed Data. Some Data provided through the Services, such as measured day-ahead electricity prices from Nord Pool and/or EPEX (“Third-Party Licensed Data”), is sourced under license agreements with third-party providers. You may use Third-Party Licensed Data solely for your own internal business purposes. You may not disclose, display, redistribute, or otherwise make Third-Party Licensed Data available externally (including through graphs, dashboards, or reports) without first obtaining a redistribution license directly from the relevant provider (e.g. Nord Pool or EPEX). Electricity Maps makes no warranties with respect to Third-Party Licensed Data and disclaims liability arising from your use or redistribution of it. For clarity, forecasted day-ahead prices and other derived or modeled data produced by Electricity Maps are not considered Third-Party Licensed Data and are licensed under these Terms without the above restriction.

Evaluation and Trial Access

Evaluation Use and Trials are provided solely for the purposes described under Evaluation Use in the Definitions section and are limited to non-production testing and assessment of the Services. They may be used only to evaluate functionality, integration, or suitability for your internal purposes and must not be relied upon for business operations, compliance, or customer-facing applications.

  • Trial Access. Electricity Maps may, at its discretion, grant temporary access to expanded features or data for evaluation purposes (“Trial”). Trials are time-limited and subject to any conditions communicated when access is granted.

  • Restrictions. During Evaluation Use or a Trial, you may not use the Services or Data to generate revenue, deliver customer-facing features, or operate any production system. Any such use constitutes Commercial Use and requires a paid Subscription or Addendum.

  • Expiry and Data Deletion. When your Evaluation Use or Trial ends, your right to use the Services and Data automatically terminates. You must delete any Data obtained during that period unless and until you enter into a paid Subscription or Addendum that expressly permits continued use.

Accounts and Access

The Services may require an account and an API token. You are responsible for safeguarding your credentials and all activity under your account. You must promptly notify Electricity Maps of any security breach that compromises your API token.


Fees and Payment

While some Services are free, paid Services are subject to fees set on our website or in an Addendum. You are responsible for all applicable taxes. Electricity Maps may suspend access for non-payment after giving notice. Unless otherwise required by applicable law or explicitly agreed in an Addendum, prepaid fees are non-refundable and forfeited upon early termination or cancellation.


Service Availability and Data Quality

Electricity Maps uses commercially reasonable efforts to maintain the availability, accuracy, and timeliness of the Services. Unless otherwise agreed in writing (for example, in an Addendum), the Services are provided without specific uptime, response time, or data completeness guarantees. Addendums may specify service levels or response times that supplement and, in case of conflict, prevail over these Terms.


Intellectual Property Rights

Electricity Maps retains all rights and ownership of the Services, API Data, Entry Data, Technology, and Marks. You only receive a license to use them as specified herein. You retain all rights to any content you develop independently. You may only use Electricity Maps Marks for attribution.

Use Period and Retention

Your right to access and use the Services and Data, whether under free, evaluation, or paid access, is limited to the period during which you have an active right to use them under these Terms, a Subscription, or an Addendum. When that right expires or is terminated for any reason, you must cease all use of the Services and Data, except that you may retain previously received Data solely for internal, non-commercial archival purposes, provided it is not used in any active product, service, or commercial process. Any continued use of the Data beyond the authorized period requires a new, valid license from Electricity Maps.


Publicity

Unless otherwise agreed in writing, Electricity Maps may identify your company by name and logo as a customer or user of the Services on our website, social media, and other marketing materials. This identification may include the use of your logo and public-facing brand name, derived from your account registration (e.g. email domain or company profile).

You may opt out of this use at any time by contacting Electricity Maps at the details outlined in the Contact section.


Confidentiality

Each party must protect the other party's non-public information with at least the same care as their own. Confidential Information does not include information that is public, independently developed, or lawfully received from a third party. Confidentiality obligations survive termination for five (5) years.


Data Protection

Both you and Electricity Maps must comply with all applicable data-protection laws, including the EU General Data Protection Regulation (GDPR).

For free, evaluation, or trial use, Electricity Maps acts as an independent controller for any personal data it collects, as described in the Privacy Policy. For paid customers, Electricity Maps acts as a data processor for any personal data processed on the customer’s behalf while providing the Services.

The following data-processing terms apply only if you have entered into a paid Addendum, Subscription, or other commercial agreement with Electricity Maps. When acting as a processor, Electricity Maps will:

  • Process Personal Data only for the purpose of providing the Services and in accordance with your instructions. If Electricity Maps considers that an instruction constitutes a violation of the applicable regulations, it shall immediately inform you.

  • To the extent possible, assist you in fulfilling obligations to respond to requests to exercise the rights of data subjects.

  • Notify you within 48 hours of any Personal Data breach within the meaning of the Personal Data Protection Legislation. Such notification shall be accompanied by any relevant documentation to enable you, if necessary, to notify the breach to the competent supervisory authority.

  • Take all necessary precautions to preserve the confidentiality and security of the Data processed and, in particular, prevent it from being distorted, damaged or communicated to unauthorized third parties, and more generally, implement appropriate technical and organisational measures.

  • Ensure that persons authorised to process personal data under this agreement (i) undertake to respect confidentiality or are subject to an appropriate legal obligation of confidentiality (ii) receive the necessary training in the protection of Personal Data.

  • Assist you in carrying out impact assessments and consultations, questions, requests or due diligence by the competent supervisory authority, including providing you with the necessary documentation to demonstrate compliance.

  • Delete or return all personal data at the end of the Services unless legally required to retain it.

  • Inform you if Electricity Maps is required by a public authority to disclose personal data, unless prohibited by law for reasons of public interest.

These clauses constitute the written data-processing agreement required by Article 28 of the GDPR for commercial customers.

Reporting and audit

The following provisions apply only if you have entered into a paid Addendum, Subscription, or other commercial agreement with Electricity Maps.

Reporting (if applicable)

If your use of the Services involves providing a version of your solution to external end-users or reselling access to Electricity Maps Data, you agree to provide, upon request and on a reasonable basis, a quarterly report specifying for each month of the preceding quarter:

  • the number of external end-users,

  • the list of end-users (including company names, if applicable),

  • the Data accessed by those end-users.

The report shall be provided within thirty (30) days after receiving such a request from Electricity Maps.

Audit Right

Electricity Maps may, at its sole discretion, audit your use of the Services and related eligibility information to verify compliance with these Terms and any applicable Addendum, particularly regarding:

  • the volume of API requests,

  • the purpose and scope of use of Electricity Maps Data,

  • where relevant, the number and type of external end-users, resellers, or white-labelled deployments and the Data they access, and

  • the accuracy of information provided for pricing or discount eligibility, including company size, number of employees, revenue, or other criteria used to determine applicable pricing tiers (such as startup or small enterprise rates).

Electricity Maps will provide at least fifteen (15) days’ prior written notice before conducting any audit. You agree to cooperate by providing Electricity Maps, or an independent auditor selected by Electricity Maps, with reasonable access to relevant documentation (including usage logs, reporting tables, or business records) necessary to perform the audit. Audits will be conducted during normal business hours and in a manner that minimizes disruption. Any information shared or accessed during such audits will be treated as Confidential Information under these Terms.

Consequences of Misuse

If an audit or report reveals documented misuse or non-compliance, Electricity Maps may, at its sole discretion:

  • apply an automatic price increase to your License Fee or Subscription charges, proportionate to the level and duration of the misuse, and

  • seek any other remedies available at law or in equity.


Term and Termination

These Terms are effective as long as you use the Services.

  • Your Termination. You may terminate by ceasing all use of the Services.

  • Our Termination. We may suspend or terminate your access immediately if you breach these Terms or fail to pay fees.

  • Effects of Termination.

    • Your license ends immediately.

    • You may retain API Data only for personal, non-commercial use.

    • You must stop using Electricity Maps Marks.

    • You must return or delete our confidential information.

    • If we terminate due to our own material breach, we will refund prepaid, unused fees.


Liability

The Services and Data are provided "as is" without warranties. Electricity Maps' liability is limited to your direct damages, capped at the total fees you paid in the six months before a claim. We are not liable for indirect or punitive damages.

Nothing in these Terms limits liability for fraud, willful misconduct, infringement of Electricity Maps’ intellectual property rights, or death/personal injury caused by our negligence.


Anti-Corruption

Both parties agree to comply with all applicable anti-corruption laws.

Updates to These Terms

Electricity Maps may update these Terms of Service from time to time to reflect changes in our Services, operations, or legal requirements. When we make changes, we will post the revised version online and update the “Last Updated” date at the top of this page.

For customers who you have entered into a paid Addendum, Subscription, or other commercial agreement with Electricity Maps, if a change materially reduces your rights or increases your obligations under these Terms (a material change), Electricity Maps will provide at least thirty (30) days’ notice by email or through the Services before the change takes effect.

Material changes include updates to:

  • fees or billing terms,

  • service availability or uptime commitments,

  • liability or indemnification provisions, or

  • data-protection commitments.

By continuing to use the Services after the effective date of an update, you accept the revised Terms. If you do not agree to a material change, you may terminate the commercial agreement by giving written notice before the change takes effect.

For users of free, evaluation, or trial use, use of the Services after the effective date of an update constitutes acceptance of the revised Terms.


Miscellaneous

  • Assignment. You may not assign these Terms without our consent. We may use subcontractors but remain responsible for their performance.

  • Entire Agreement. These Terms, together with any Addendum, constitute the entire agreement between you and Electricity Maps concerning the Services. In the event of a conflict, the Addendum prevails over these Terms.

  • Governing Law. Danish law governs these Terms.

  • Dispute Resolution. Disputes will be resolved by arbitration in Copenhagen through the Danish Institute of Arbitration.

  • Severability. If any provision is found invalid, the rest of the Terms remain in effect.
